Video: Federal Agent Harasses Law Abiding Citizen And Tries To Take Away His Guns – The Police Comes And Serves The Fed Instant Justice

An agent with the Bureau of Alcohol, Tobacco, and Firearms has filed a federal lawsuit accusing two Columbus police officers of using excessive force against him while he was working in his official capacity.

James Burk, a 16-year veteran of the ATF, went to a house in the 3300 block of Edgebrook Drive near Dublin to take a shotgun from someone who allegedly wasn’t allowed to have a gun, even do it wasn’t confirmed by the police if the man wasn’t allowed to have a gun!

Nothing else was reported about the ATF agent’s mission.

When Burk knocked on the home door, a person inside called 911 and read the dispatcher Burk’s badge number while refusing to open the door.

Burk said the dispatcher told the 911 caller not to answer the door and dispatched Columbus police officers Joseph Fihe, a 20-year member of the division, and Kevin Winchell, who is also a 20-year veteran officer.

Officer Fihe, who had arrived first, was seen pulling his revolver on ATF Agent Burk when he rejected instructions to reveal identification or “get on the ground.”

Officer Winchell instantly drew on Agent Burk when he arrived. The lawsuit said Burk told Fihe and Winchell, that his credentials were in his pocket.

Fihe pointed his firearm at Burk for more than 90 seconds, before both Fihe and Winchell “climbed on his back while violently twisting and pulling his arms to handcuff him.”

The lawsuit said the officers also used a Taser on Burk multiple times while he was face down and “not evading arrest” before handcuffing Burk and placing him in the back of a cruiser, a process that involved pulling him into the car because a seatbelt was in the way.

After about an hour, during which Burk said he was denied water and “frequently disparaged … to everyone in earshot” by Fihe, Burk was released without charges.

Burk has since moved to an administrative role within ATF because of the incident and injuries, both physical and psychological, Burk says he suffered.

The lawsuit names the City of Columbus, Fihe, and Winchell as defendants and argues this is part of a pattern of misconduct by Columbus police and a lack of investigation into officers’ behavior, calling it “unconstitutional policing.”

The incident occurred on July 7, 2020, but now the video from the arrest is making its rounds on social media.

If they didn’t kill the agent’s adolescent son and his wife, it wasn’t “excessive force”. I’m sure Randy Weaver would agree.

Fed acting like ******* encountering local pd and continuing to act like ******* and suffering the consequences. Glorious. One hopes the citizen that he was harassing is legit. We have no way of knowing.

The Feds think they are like the Gestapo, accountable to no one but other Gestapo, and that they do not have to obey the local cops…and they also think they can infringe the hell out of our right to keep and bear arms, although the government is specifically and clearly prohibited from doing that!

Poor babies don’t like it when they are on the receiving end. The lawsuit is a fraud. Watch the video, arrogant slob would not follow police instruction, threatened them with making a bad mistake, then resisted getting handcuffed. If you or I did the same the officers would have treated us the same. That’s how equal treatment under the law works…shocking.

ATF is a rogue Federal Agency , remember the raid in Waco, and remember Fast and Furious, giving guns to Mexican criminal and one killed a Border agent , he was dressed like a criminal and had a pistol ,if it had been the other way around the cops would have been dead and nothing would have been said , ATF and FBI should be disbanded now, they are out of control.
